Small Help — Terms & Conditions

These Terms of Use govern your access to and use of the Small Help platform, including donations, starting or managing campaigns, and related services. By using our website or services, you agree to these Terms.

1. Definitions

“Small Help” means the Small Help platform operated by Small Help Humanitarian Foundation (registered with the Corporate Affairs Commission of Nigeria), including our website, services, and related systems.

“Campaign” means a fundraising page or initiative published on Small Help to raise funds for a beneficiary’s medical needs or related humanitarian support.

“Donor” means an individual or organization who contributes funds via the platform. “Beneficiary” means the individual or institution for whom funds are raised. “Partner” includes hospitals, NGOs, or verifiers collaborating with Small Help.

2. Eligibility & Accounts

  • You must be at least 18 years old or the age of majority in your jurisdiction to use the Services. If you are under 18, you may only use the Services under the supervision of a parent or legal guardian.
  • You agree to provide accurate, current, and complete information and to keep your account details up to date.
  • You are responsible for all activity under your account and for safeguarding login credentials (including email verification codes).

3. Acceptable Use

  • Do not use the Services for any unlawful purpose, fraud, misrepresentation, or to solicit funds for ineligible or deceptive purposes.
  • Do not upload content that is defamatory, obscene, hateful, or that violates third‑party rights.
  • Do not interfere with platform security, attempt to access others’ data, or misuse payment systems.
  • Comply with applicable laws, medical advertising rules, and fundraising regulations in Nigeria and your location.

4. Donations

  • Donations are voluntary and, unless required by law, are generally non‑refundable. We may consider refunds in limited cases (e.g., proven fraud or error). See our Help Center for the refund flow and timelines.
  • Donations are not deposits or investments and may not be tax‑deductible. Consult your tax adviser regarding eligibility in your jurisdiction.
  • Receipts are issued for transparency. They may not qualify as tax receipts unless explicitly identified as such.

5. Campaigns & Verification

  • All campaigns must be truthful, supported by required medical documents and identity verification, and comply with our publishing criteria.
  • Small Help may verify information with hospitals, partners, or third‑party services and may request additional documents at any time.
  • We may suspend, edit, or remove campaigns that violate these Terms or our policies, or that present risk to donors, beneficiaries, or the public.
  • Stories and images must respect dignity and privacy. Sensitive content must be handled with care and consent.

6. Payments, Disbursements & Fees

  • Payments are processed by approved payment providers. You authorize us and our processors to charge your selected payment method.
  • Disbursements are made directly to hospitals or partners, not to individual patients, unless expressly stated otherwise.
  • Platform fees and third‑party processing fees may apply and will be disclosed during checkout or on the campaign page.
  • We may hold funds or delay disbursement pending verification, suspected fraud, chargebacks, or legal requirements.

7. KYC/AML & Sanctions

  • We implement Know‑Your‑Customer (KYC) and Anti‑Money‑Laundering (AML) controls, including identity checks and transaction monitoring.
  • We do not support transactions involving sanctioned persons, entities, or regions. You confirm you are not subject to applicable sanctions.
  • We may request additional information to comply with law enforcement or regulators and may suspend use until requirements are met.

8. User Content & IP

  • You retain ownership of content you submit. You grant Small Help a non‑exclusive, worldwide, royalty‑free license to use, reproduce, display, and distribute such content to operate and promote the Services.
  • Do not upload content you do not have rights to use.
  • We may remove or restrict content alleged to infringe others’ rights. You may report concerns via the Contact section.

9. Privacy & Data Protection

Our Privacy Policy explains how we collect and process personal data, including contact details, verification documents, and payment information. By using the Services, you consent to our data practices.

We apply appropriate technical and organizational measures to protect data. However, no method of transmission or storage is 100% secure. Notify us immediately of any suspected unauthorized access.

10. Disclaimers

  • No medical advice. Content on the platform is for information only and not a substitute for professional medical advice.
  • No guarantees. We do not guarantee that any campaign will achieve a particular funding goal or outcome.
  • Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non‑infringement.

11. Limitation of Liability

To the fullest extent permitted by law, Small Help and its officers, employees, and partners are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenues, arising from your use of the Services.

Our aggregate liability for any claim arising from the Services will not exceed the greater of: (a) the fees you paid to us in the 6 months before the claim, or (b) NGN 100,000.

12. Indemnity

You agree to defend, indemnify, and hold harmless Small Help from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your violation of these Terms or misuse of the Services.

13. Suspension & Termination

We may suspend or terminate your access to the Services at any time for any reason, including suspected fraud, policy violations, or legal risk. Upon termination, your right to use the Services ceases immediately.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes shall first be addressed through good‑faith negotiations. If unresolved, disputes may be referred to mediation or arbitration in Lagos, Nigeria, in English, under applicable rules agreed by the parties.

15. Changes to These Terms

We may modify these Terms from time to time. The “Effective” date will be updated when changes are made. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
